Testament of Mme Rbt Layfield
no 1691
On this neniteenth day of the
month of march in the year of
Our Lord one thousand eight hun-
dred and seventy three.
At the request of Elisabeth
Fraser, wife of Robert Layfield,
Esquire senior farmer of the town-
ship of Inverness, province of Quebec
Dominion of Canada, the said lady,
Elisabeth Fraser, living with her
husband, at the undersigned Notary
Public duly admitted and sworn in and
for that part of the Dominion of
Canada called province of Quebec,
residing in township of South
Halifax in the district of Artabas-
ka said province, and the witnesses
hereafter named ... to the dwel-
ling of the said Elisabeth Fraser,
where we find her good health
of body and of sound mind, memory
and understanding as it appear
on to us said Notary and witnesses
by her manner and conversation.
Who in view of death have
requested us said Notary in presen-
ce of the said witnesses, to take
down and received her last will
and testament witch she instan-
tly dictated on to us as fallows
to ...
1° I recommanded my soul to al-
mighty god praying for ...
of
of my sins through the merit of
Jesus Christ my savior
2° I direct that my just debts be
paid by my executors hereafter na-
med after my dead and that my
body be buried in a Christian man-
ner after my death.
3° I give and bequeath to my dau-
ghter Emma Layfield, spinster
a sum of money of one hundred
and fifty pounds currency of this
province, to have and to hold
use and enjoy that said amount
by my said daughter Emma only
after my death and after the death
of Robert Layfield, my beloved
husband; I hereby institute her
by these presents my particular
and residuary legatee, in property
to that effect.
4° Further I give and bequeath
to my dear husband Robert
Layfield all the remainder of
my personnal and real estate, mo-
veable and immoveable that I
now have or may have or pre-
tend to at the time of my decease.
I hereby institute him my uni-
versal and residuary legatee in
property to that effect
5° And for the due execution
of this present will and tes-
tament
tament I do hereby nominate, consti-
tute and appoint Henry Layfield,
Miller, of the township Wins-
low, in the said province of Que-
bec, my son, and Agnes Layfield,
my daughter, spinster, living with
me, executors of this my will
authorising them to act jointly or
separatly as it will be necessary,
hereby revoking and making void
all former and other wills by
me at any time heretofore made
and declare this only to be my last
will and testament.
Thus done and dictated by the
said testatrix to us said Notary in
the presents of the said witnesses
and after these presents having
been read over to the said testatrix by
the said Notary in the presence of
the said witnesses the said testatrix do de-
clare this to contains her last will and
testament.
In the residence of the said testatrix
on the day, month and year first above
writin, under the numer one thou-
sand six hundred and ninety one in the
presence of Duncan Stuart, for-
mer, of the said township of In-
verness, and John Mckenzie,
merchants of the said township
of Inverness, both witnesses
called expressely
for
for the execution of these pre-
sents and the said testatrix
and the said witnesses have
signed there names with us
said Notary, after duly read-
ing according to law, three
words crossed are null.
